Global Business Contract Management

In its simplest form, contract management is about the controlling and managing of contracts - through all stages - with partners, employers, customers and vendors.

When it comes to global business, you can't afford to operate without contract management due to the current climate that puts added pressure on cutting costs.

When done correctly, contract management has the ability to maximise the financial potential of a company while also minimising any potential risks.

How important is contract management?

Preparation- it is impossible to predict any issues that will unfold within a company, but it is possible to be ready to deal with them should they arise.

Proactive- Contract management rightly assumes that there will always be disagreements between the parties involved, the faster the companies act the faster any problems can be eradicated.

It is common that there will be a disagreement regarding delivery speed and pricing strategies for example. Contract management can settle disputes by creating a new and improved version of the contract, or scrapping the existing one all together.

Keeping both parties happy - Ultimately, contract management ensures that there's an acceptable balance between what is required and how it will be achieved between the two in question. The needs and wants of either side are known thanks to the system of contract management and this makes it easier to find fair outcomes.

The beauty of contract management is that it stops verbal or gentleman's agreements which can often work as a negative leading to a failure to agree terms due to a breakdown in communication.

Contract manager roles...

To have a detailed knowledge of the contract and any legal obligations involved within the terms and conditions

The contract manager must be skilled in both contract management skills and with more general commercial skills, also to be a good judge of character in order to act fairly and responsibly

In summary the contract manager has delegated authority to manage the contract effectively

Good contract management can effectively accelerate the agreement process, and more importantly reduce the legal costs that come hand in hand with contract proceedings.

As with many things in life, the idea behind contract management is that it helps both parties to effectively reach their goals and be happy with the service received.

It is the responsibility of the contract manager to ensure that both parties are performing, baselines are understood by both firms, and suppliers understand the service they are required to deliver.

Customer organisation moves into the hands of the contract manager to maintain happy negotiations through providing the supplier with the contacts and information needed to deliver the service appropriately.
